THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16231 OF 2017 ORDER :

This Writ Petition is filed as against the order dated 06.03.2017 passed by respondent No.3 (Deputy Commissioner of Prohibition And Excise, Khammam) directing the petitioner to produce the vehicle bearing No.TS-03UA-2920 on account of appeal filed by him having been dismissed, and the vehicle is liable to be confiscated.

Learned counsel for the petitioner submits that the revision filed by the petitioner on 02.03.2017 is pending before respondent No.1; and, this Court, in large number of cases, granted stay till the disposal of the revision.

Learned Government Pleader for Excise (TG) does not dispute about the said aspect.

In the circumstances, the Writ Petition is disposed of with a direction to respondent No.1 to dispose of the revision, after giving an opportunity of hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of the order. Till such an order is passed by respondent No.1, there shall be stay of seizure of vehicle by respondent Nos. 3 and 4 subject to the petitioner producing vehicle before respondent No.3, and also documents relating to the vehicle so as to verify whether the

vehicle has not been transferred and no encumbrance created, within a period of two weeks from the date of receipt of a copy of this order.

Consequently, the miscellaneous applications, if any shall also stand disposed of.
