THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8146 of 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-1 under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.47 of 2016, on the file of Narsampet Town Police Station, Warangal District, registered for the offences punishable under Sections 506 read with 34 IPC and Section 3(1)(x) of SCs & STs (POA) Act, 1989. Heard and perused the material available on record. The allegation against the petitioner is that on 09.09.2015 at about 12.00 hours at P.H.C. and on 14.10.2015 at about 16.00 hours at Durga Bhavani Sweet house, Narsampet, A-1 along with A-2 and A-3 abused the de facto complainant in the name of caste in public view as the de facto complainant questioned the accused about not attending their duties regularly and not doing their duties properly in the P.H.C., Bhanjipet Village and threatened him with dire consequences. The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
