ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Home.

Petitioner alleges that for the last six months, the Station House Officer, Bhavanipuram Police Station/ 3rd respondent with the assistance of Station House Officer, Basanthnagar police station, Peddapalli district/4th respondent sending male constables to take her along with them forcibly without disclosing the reasons after sun set by hiring auto on the premise that she was called by 3rd respondent. It is further alleged that for the last three weeks, respondents 3 and 4 are making phone-calls through different cell phones, asking her to approach 3rd respondent without assigning reasons for summoning. This writ is filed alleging that her personal life is totally affected, self respect is damaged and there is danger to her life and safety.

Prayer sought in the writ petition is to declare the action of 3rd respondent in summoning and taking the petitioner into illegal custody with assistance of 4th respondent and retaining her in respective police stations without assistance of women cops and without disclosing any cause for summoning and questioning about her son, who is already in jail. 3.

Learned Government Pleader produced copy of the crime registered in Bhavanipuram police station on 24.10.2018 vide FIR No. 674 of 2018. The contents of the FIR would disclose that parents of a girl child complained that their daughter is missing and her whereabouts are not known, however, no person is named as accused. 4.

In written instructions furnished by 4th respondent, he denies the allegation of making telephone calls and trying to apprehend

and categorically denies that he is no way concerned with the case pending in the State of Andhra Pradesh.

In view of the categorical statement of 4th respondent, the apprehension expressed by the petitioner no more survive. However, it is needless to observe that unless any crime is registered and petitioner is required for investigation, petitioner should not be called by the police. Accordingly, the writ petition is disposed of. Miscellaneous petitions, if any pending, are closed.
