THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.248 of 2018 ORDER:

This contempt case was instituted alleging wilful disobedience to the order dated 26.04.2016 passed by this Court W.P.No.14475 of 2016. By the said order, this Court directed the police authorities to follow the law laid down by the Supreme Court in LALI TA KUMARI v. GOVERNMENT OF UTTAR PRADESH1.

The Inspector of Police, Penamaluru Police Station, Vijayawada City, filed a counter-affidavit stating that pursuant to the private complaint dated 16.11.2015 filed by the petitioner in relation to his earlier complaint dated 13.04.2015, the learned IV Additional Chief Metropolitan Magistrate, Vijayawada, directed the Station House officer, Patamata Police Station, Vijayawada city, to register a crime and investigate the same. Pursuant thereto, Crime No.868 of 2015 was registered on 19.02.2015 under Sections 390, 204, 120 (b) IPC read with Sections 43, 65 and 66(b)(c) & (e) of the Information and Technology Act, 2000, on the file of the Patamata Police Station.

In the light of the registration of the crime, the complaint of the petitioner as to disobedience to the order dated 26.04.2016 passed by this Court in W.P.No.14475 of 2016 does not survive.
