HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.12115 of 2008 ORDER :

One Kurella Damodar Rao has filed the writ petition challenging the order No.237/98-99, dated 11.06.2007. At the time of hearing, learned counsel for petitioner submits that the petitioner is no more. The fact of the matter is nothing further could happen in the matter pursuant to order No.237/98-99, dated 11.06.2007. With the demise of petitioner, it is needless to observe that the respondents, if intend to proceed further in the matter, are under legal obligation to bring the legal representatives on record and proceed in accordance with law. The legal representatives are given liberty to approach 2nd respondent and request for one time settlement to avoid further complications in the matter. If any such representation is made to the 2nd respondent, the 2nd respondent is directed to consider and pass appropriate orders in accordance with law before proceeding to auction the property.

Writ petition is disposed of as indicated above. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
