HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 29103 of 2012 Order:
The petitioner is a resident of Weavers Colony, Hindupur Mandal, Anantapur District. He was doing some petty business for his livelihood. He was an accused in Crime No.83 of 1999, wherein a charge sheet was filed in CC No.56 of 2000 on the file of the Judicial Magistrate of First Class, Hindupur. He was acquitted in the said case. Since no other case is pending, the petitioner states that the rowdy sheet opened against him should have been closed. He also submits that he submitted a representation on 05.07.2012 and without considering the said representation he was being harassed.
2. A counter affidavit is filed stating that the petitioner was involved in three criminal cases, out of which in one case he was acquitted and in two other cases he was bound over for a period of six months. In order to curb and curtail the unlawful activities of the petitioner a rowdy sheet was opened in II Town Police Station, Hindupur and the rowdy sheet was being continued up to 03.12.2012. Later on, the rowdy sheet was transferred to Hindupur Rural Police Station limits on the point of jurisdiction. As on the date of filing of the counter on 21.09.2012 no case was pending or registered against the petitioner. But, in view of the action of the petitioner posing himself as rowdy sheeter, the rowdy sheet is being continued.
3. In the absence of any latest information against the activities of the petitioner, this Court is constrained to dispose of the Writ Petition directing the respondents 1 and 2 to consider the representation of the petitioner dated 05.07.2012 and pass appropriate orders in accordance with law within a period of three (3) months from the date of receipt of a copy of this order and communicate the same to the
petitioner.
4. The Writ Petition is, accordingly, disposed of. However, in the circumstances, no costs.
5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
