THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28558 of 2014 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader for the respondents 1 to 3. 2.

The prayer sought in the writ petition is as under:- "....to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, by declaring the action of the respondent 3 and 4 in not releasing the petitioner's wife Mrs.B.Pallavi who is under custody of 4th respondent's home, as illegal and arbitrary, against violate of article 14, 19 and 21of Constitution of India and against the principles of natural justice consequently direct the respondents 3 and 4 to release the petitioner's wife Mrs.B.Pallavi from the custody of the 4th respondent and handed over to the petitioner and pass such other order or orders as may deem fit and proper in the circumstances of the case."

Learned Government Pleader, during the course of hearing, brought to the notice of this Court that one B.Sathaiah lodged a complaint on 14.05.2014 stating that his daughter was kidnapped by the petitioner and had sexual intercourse at various places and requested the police to take necessary action. Pursuant to the said complaint lodged by the said B.Sathaiah, a case in Crime No.176 of 2014 for the offences under Sections 375(4), 376 and 366-A IPC and Section 3(b) of the Protection of Children from Sexual Offences Act, 2012, was registered against the petitioner. After completion of investigation, charge sheet was filed before the concerned Court on 20.10.2014. The same is taken on file as S.C.No.15 of 2015 and after trial, the petitioner was acquitted in the above said sessions case.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand dismissed.
