HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.5848 of 2012 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents, in not providing a time-table and in making unethical efforts to restrain the petitioner from attending 2nd year B.Ed examination, as illegal and arbitrary. A consequential direction is sought to respondent Nos.2 and 3 to issue a time table for the B.Ed. examination scheduled to be held on 06.03.2012.

The petitioner's complaint in the writ petition is that he has been prevented from appearing for the B.Ed 2nd year examination scheduled to be held on 06.03.2012. By the interim order, in WPMP.No.7399 of 2012 dated 02.03.2012, this Court directed the respondents to issue hall ticket to the petitioner, and allow him to attend the 2nd year B.Ed examination.

No counter affidavit is filed by the respondents. As the petitioner must have appeared for the 2nd year B.Ed examination, pursuant to the interim order in the year 2012 itself, and as six years have elapsed since then, he must have completed the course by now. It is evident, therefore, that the cause in the writ petition does not survive necessitating any further adjudication by this Court. The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall

also stand dismissed. However, in the circumstances, without costs.
