THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.17154 of 2013 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"To issue any appropriate writ, order or direction more particularly one in the nature of a Writ of Mandamus directing the Respondent No. 3 not to illegally detain the Petitioners and/or including calling/summoning the Petitioners without following the due process of law". 2.

Today, when the matter is called, the learned Government Pleader appearing for Respondents placed on record the written instructions dated 1.7.2013 furnished by the Sub-Inspector of Police, Port Police Station, Kakinada, East Godavari district. The said instructions read as under: "It is submitted that on 11.6.2013, the 4th respondent herein Sridhar Babu, General Manager of M/s SRR Projects Pvt. Ltd., had lodged a complaint with the SHO Port P.S. Kakinada, stating that he supplied iron and workers to the petitioners herein i.e. Challapalli Satya Siva Prasad and Polumatla Suresh Kumar, who are Managers of M/s FGI Company, but the petitioners failed to pay the amount of Rs.72 lakhs to the complainant, hence the complainant requested the police to take necessary action. It is submitted that as huge amount involved, hence the SHO Port P.S. has informed the same to the Circle Inspector of Police, Kakinada Town Circle for favour of information.

It is submitted that basing on the said complaint, the Circle Inspector of Police, Kakinada Town Town Circle has enquired the matter in detail and it was revealed that there was a civil dispute with regard to the money transaction between the petitioners and 4th respondent, hence the Circle Inspector of Police, Kakinada Town suggested both the parties to approach Court of law for redressal.

It is submitted that except receipt of the said complaint from the 4th respondent, the Circle Inspector of Police, Kakinada Town Circle or SHO Port

P.S. have never harassed, threatened and interfered with the life and liberty of the petitioners by detaining them in the police station". 3.

On noticing the same, a request is made by the learned counsel for the petitioner to place on record the said written instructions. 4.

In view of the above, the writ petition is disposed of, by placing on record the said written instructions dated 1.7.2013 furnished by the SubInspector of Police, Port Police Station, Kakinada, East Godavari district. As a sequel, the Miscellaneous Petitions, if any, shall stand closed. There shall be no order as to costs.
