THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR Criminal Petition No.2963 of 2015 ORDER:- The petitioners/ accused Nos.1 to 4 filed the present application under Section 438 Cr.P.C seeking release in the event of their arrest in connection with Crime No.190 of 2015 of Afzalgunj Police Station, Hyderabad, registered for the offences punishable under Section 324, 354, 290, 506, 384 r/2 34 IPC and Section 3

(1) (ix) of SCs & STs (POA) Act, 1989.

2). The case of the prosecution is that:

On 23.03.2015 at 5.00 p.m., the accused Nos.1 to 5 along with others came to the shop of the informant and abused her in filthy language. When she asked the reason for the same, they are alleged to beat her with sticks and knifes. The 2nd petitioner is alleged to have bet with stick and torn her blouse causing bleeding injuries. When the workers of the informant came to her rescue, the accused also beat them. The accused also abused the informant by touching her caste. The accused are alleged to have trespassed into the shop of the informant, damaged the entire shop and also snatched away her purse. Basing on these allegations, the present complaint came to be filed.

3. Heard learned counsel appearing for the petitioners and learned Additional Public Prosecutor appearing for the respondent-State.

4. The averments in the report disclose that all the accused have not only beat the informant with sticks on legs but also abused her in filthy language touching her caste. The report also discloses that the accused are alleged to have outraged the modesty of the informant by tearing her blouse.

5. Having regard to the nature of allegations made, I am not inclined to grant anticipatory bail to petitioners. However, the petitioners are directed to surrender before the concerned Court and make a suitable application, in which event the same shall be dealt with on merits in accordance with law either on

the same day or atleast by next day.
