THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27611 of 2017 ORDER:

In the present writ petition, challenge is to the alleged action on the part of respondent Nos.3 to 5 in not permitting the petitioner to conduct the business in the premises bearing D.No.17-2-18, Suddapalli Donka, Old Guntur, Guntur.

In the instant case, the Prohibition and Excise Superintendent, Guntur, issued Form 2B licence in favour of the petitioner on 01.07.2017.

It is submitted by the learned counsel for the petitioner that the said licence granted in favour of the petitioner is still intact and only on the ground that local residents are objecting, the respondent authorities are not permitting the petitioner to carry on the business.

In the considered opinion of this Court, the said action on the part of the official respondents cannot be sustained so long as the licence granted in favour of the petitioner subsists. However, this order will not preclude the respondents from taking action in accordance with law.

With the above observation, the writ petition is disposed of. No order as to costs.
