HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No. 1305 of 2019 ORDER: (per V. Ramasubramanian, J)

1) The petitioner has come up with the above writ petition challenging a condition imposed by the Debts Recovery Tribunal for the grant of interim stay of an e-auction.

2) On 25.01.2019 when the writ petition came up for orders as to admission, this Court passed a conditional order, which reads as follows:

"M/s. Pearl Law Associates, take notice. There will be interim stay of further action till 04.02.2019 subject to the condition that the first instalment of 10% as ordered by the Debts Recovery Tribunal is paid by the petitioner to the respondent bank on or before 04.02.2019. Post on 05.02.2019 for reporting compliance."

3) Today it is reported by Mr.Maruthi Jadav, learned counsel for the Bank that the interim order was not complied with. We see no reason to entertain the writ petition. The petitioner does not deserve any indulgence. Hence, the Writ Petition is dismissed.

As a sequel, miscellaneous petitions, if any, pending in the Writ Petition stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J ___________________ P. KESHAVA RAO, J February 6, 2019 gkv
