THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION Nos.31031 AND 31032 OF 2015 COMMON ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

Both the petitioners claim that they were granted D-Form pattas. While the petitioner in W.P.No.31031 of 2015 claims to be an allottee to an extent of Ac.2.00 of land in Survey No.185/3, the petitioner in W.P.No.31032 of 2015 claims to be an allottee to an extent of Ac.4.50 cents of land in Survey No.186/1 of Marrigunta Village, Kondapur Mandal, S.P.S.R. Nellore District. Both the allotments are stated to be 1417 F. The grievance of the petitioners is that in spite of number of requests, the lands have not been demarcated and handed over to the petitioners.

Learned Government Pleader for Revenue, on instructions, submits that the petitioners were allotted D-Form pattas as claimed by them. However, it is stated that due to disputes with the neighbouring land owners and due to non-availability of permanent Surveyors in Kondapuram Mandal, the lands could not be surveyed and could not be shown to the petitioners. It is further stated that one surveyor is now available and he is presently engaged in the Government Programme "Mee Intiki Mee Bhoomi" and soon after completion of the said programme, the subject lands would be surveyed and shown to the petitioners.

The said instructions of the Tahsildar, Kondapuram Mandal, SPSR Nellore District, the 2nd respondent, show that appropriate action would be taken as soon as the survey is completed.

In view of the same, these Writ Petitions are disposed of directing the 2nd respondent to get the survey work completed expeditiously and take further consequential action by allotting the subject lands to the petitioners in terms of D-Form pattas already granted to them, preferably within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
