HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.1185 of 2020 ORDER :

This writ petition is filed aggrieved by action of respondents in interfering with the possession and enjoyment of petitioner over his property bearing premises No.8-1339/15/16, BJR Nagar slum, Film Nagar, Shaikpet village, Banjara Hills, Hyderabad without issuing any notice and without following due process of law.

Heard learned counsel for the petitioner, who, submits that petitioner was granted D-form Patta vide Proceedings No.F/14586/96, dated 21-10-1995 admeasuring 50 square yards, in Sy.No.403 situated at BJR Nagar slum, Film Nagar, Golconda Taluk, Shaikpet Village, Banjara Hills, Hyderabad and after delivery of possession, she constructed a dwelling unit. But the respondents without following due process of law trying to dispossess the petitioner from the subject property.

Learned Assistant Government Pleader for Revenue produced written instructions stating that application of the petitioner for regularization of subject property was rejected and the appeal filed against the same was also rejected and possession of said property is with the Government. It is also stated that house number which is mentioned by the petitioner stated supra does not correlate to the so-called

patta granted to the petitioner.

Learned Assistant Government Pleader also filed copies of rejection orders. In view of the rival contentions, there appears to be serious dispute regarding identity of the property. This Court cannot go into the disputed questions of fact in the writ petition. As such, I do not see any reason to entertain the writ petition.

Accordingly, this writ petition is dismissed. It is open for the petitioner to avail alternative remedy available to her under law. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
