In this Petition filed under Section Cr.P.C, petitioner/ A2 seeks pre-arrest bail in Crime No. 38 of 2016 of Gadwal Rural Police Station, Jogulamba Gadwal District, wherein the accused allegedly committed offences under Sections 498-A & 306 IPC read with Section 34 IPC.
The deceased is wife of A1. Petitioner/ A2 is sister of A1. The crux of the case is that the deceased allegedly consumed pesticides and committed suicide due to the harassment meted by A1 and A2. It is further alleged that on 9.5.2016 in the evening at about 5.00 p.m A1 and petitioner/ A2 abused her and asked her to consume pesticide and die and in fact they allegedly placed some pesticides in front of her, locked the door and went away and in some time thereafter she consumed pesticide. On knowing this incident, when the brother of deceased went to the house of the deceased she informed the said fact to him. He admitted her in the hospital at Gadwal, where she succumbed to death.
Having regard to the gravity of the charge and prima facie material against the petitioner/ A2, it is not a fit case to grant anticipatory bail to her. While dismissing the Criminal Petition, petitioner/ A2 is directed to surrender before the concerned Court
and seek for regular bail, in which case, the concerned Court shall dispose of the petition on merits on the same day. As a sequel, miscellaneous applications pending, if any, shall stand closed.
