The petitioner is a sick industry. It filed the present writ petition questioning the demand notice No.MRO's Rc.(D)/293/2005, dated 15.03.2005, issued by the Mandal Revenue Officer, Kurnool, third respondent herein, in pursuance of the dues raised by the Divisional Forest Officer, Logging Division, Giddalur, Prakasam District, fourth respondent herein. 2.

This Court, by order dated 31.03.2005 in WPMP.No.9192 of 2005, granted interim suspension of the impugned notice. 3.

Heard.

During the course of arguments, the learned counsel for the petitioner has brought to the notice of this Court G.O.Rt.No.663, Industries & Commerce (IP) Department, dated 31.10.2009, wherein at clause No.4(1), the Government has extended to the petitioner the benefit of waiver of the dues payable to the Forest Department and submitted that the same needs to be considered. 5.

In the light of the above, the petitioner is directed to submit a representation before the District Collector, Kurnool, first respondent herein. On receipt of such representation from the petitioner, the first respondent shall consider the same in the light of G.O.Rt.No.663, Industries & Commerce (IP) Department, dated 31.10.2009, and pass appropriate orders thereon as soon as

possible. Till passing of orders by the first respondent, the impugned order dated 15.03.2005 of the third respondent shall be kept in abeyance.
