THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.520 of 2025 ORDER:

Seeking the Court to enlarge the petitioners who are arrayed as accused Nos.8, 10, 12 and 13 in Crime No.184 of 2024 of Madgul Police Station, Ranga Reddy District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that 18.11.2024, the defacto complainant lodged a report before the Police stating the de-facto complainant is working as Ex-Sarpach of Nagilla village stated that on 17.11.2024, one person Yallaiah and Srinu, who is the own brother-in-law of Yallaiah and both are quarrelled with each other and sustained blood injuries and died on the spot. Hence, a case was registered vide Crime No.184 of 2024 before the Madgul Police Station, Rachakonda, for the offences punishable under Sections 103 of BNS. Later, during the investigation, the Police came to know that the A1 to A14 attacked Yadaiah with granite stones, bricks and with a centring stick, due which deceased was fell down and died on the spot.

Heard Sri Uduthala Jagan, learned counsel appearing on behalf of the petitioners as well as Sri Syed Yasar Manoon,

learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners firstly submitted that the petitioners are innocent and they are no way concerned with the alleged offences. He secondly submitted that all the material witnesses were examined, and further detention of the petitioners is unnecessary. He thirdly submitted that initially the crime was registered on the complaint given by the de-facto complainant and in the said complaint there is no allegations are leveled against the petitioners in the commission of the said offences and petitioner Nos.1 to 3 have been in judicial custody since 23.12.2024, causing undue hardship to their families and that the allegations are false and fabricated.

He fourthly submitted that the petitioners are residents of Madgul Mandal, Ranga Reddy District, with movable and immovable properties, and are willing to furnish sureties as directed. He lastly submitted that previously, bail application of the petitioners, vide Crl.M.P.No.5 of 2024 was dismissed by the XV Additional District and Sessions Judge-Cum-Additional Metropolitan Sessions Judge, Cyberabad at Ibrahimpatnam, Ranga Reddy District, on 08.01.2025 without valid reasons and prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are severe in nature and the petitioners are actively presented in the crime along with other accused and the investigation is not yet completed, therefore, granting bail to the petitioners, at this stage, does not arise. Hence, he prayed the Court to dismiss the criminal petition.

After considering submissions from both the parties and reviewing the record, it is apparent that except omnibus allegations, there are no specific allegations against the petitioners. It is pertinent to note that petitioner Nos.1 to 3 are languishing in jail from 23.12.2024 and also material part of investigation is completed. Hence, this Court deems it fit to grant bail to the petitioners subject to the following conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the XV Additional District and Sessions Judge, Ranga Reddy District at Ibrahimpatnam.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on

every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
