This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by petitioner/A.1 seeking regular bail in connection with Crime No.108 of 2025 of Central Crime Station, Hyderabad District. The offences alleged against the petitioner are under Section 316(2), 318(4) r/w.61(2) of Bharatiya Nyaya Sanhita, 2023 and under Section 5 of the Telangana Protection of Depositors and Financial Establishment Act, 1999 (for short 'Depositors Act').

The facts of the case are that on 29.08.2025 the defacto complainant lodged a report stating that one Khaja Pasha approached him in the month of June 2024 and insisted him to invest in Metaplus Trading Company. Believing the same to be true, the complainant invested huge amount. The petitioner herein lured him under the guise of good returns and the complainant invested his hard earned and borrowed money basing on the illegal assurances given by the petitioner to a tune of Rs.2.5 Crores between September to November 2024 and only Rs.40 lakhs was returned to the complainant. Hence, requested the police to take necessary action against the accused. Basing on the said complaint police registered the case against the accused for the said offences.

Heard Ms. Mukkera Sahithi Sri Kavya, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondentState. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and there are four crimes registered against him and in all those crimes petitioner was enlarged on bail. Petitioner herein is in jail from 22.11.2025
- 3 - and the material part of investigation is already completed as such, custodial interrogation of the petitioner is not necessary. Hence, prayed this Court to grant regular bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed bail contending that there are number of victims in the hands of petitioner, several crimes are registered against him and investigation is not yet completed. Hence, prayed this Court not to grant bail to the petitioner and to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, the petitioner is in jail from 22.11.2025 in this crime and he is already enlarged on bail in the other crimes registered against him. Considering the allegations against petitioner and period of incarceration, this Court deems it fit to grant regular bail to the petitioner subject to the following conditions : i. The petitioner/A.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction XII Additional Chief Judicial Magistrate at Nampally, Hyderabad District.
ii. The petitioner/A.1 shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m.,
- 4 - on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioner/A.1 shall abide by the other conditions stipulated in Section 483(2) of the BNSS. 7.
Accordingly, Criminal Petition is allowed.
Miscellaneous petitions, if any, pending shall stand closed.
