HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1331 OF 2019 O R D E R:
The grievance of the petitioner is with regard to the award dated 03.05.2017 passed by The Deputy Registrar of Chits / Arbitrator, Ranga Reddy District, in Dispute No.933 of 2014.
Admittedly, the impugned award is appealable under Section 70 of the Chit Funds Act, 1982. When a more effective remedy is provided under the statute, it is not open to the petitioner to approach this Court by way of a Writ Petition under Article 226 of the Constitution. Trite to state, the scope of a statutory appeal would be far wider than the enquiry that can be undertaken by this Court in a Writ Petition. It is therefore not open to the petitioner to circumvent the effective statutory remedy provided to him and approach this Court directly. The Writ Petition is dismissed leaving it open to the petitioner to avail statutory remedy in accordance with law. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
