HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.1755 OF 2016 ORDER:

The Civil Revision Petition is filed under Article 227 of Constitution of India by the petitioner/ plaintiff, impugning the order passed on 18.03.2016 in I.A. S.R. No.878 of 2016 in O.S. No.3 of 2005 on the file of the Second Additional District Judge, Kadapa at Proddatur.

2) Heard learned counsel for petitioner.

3) The revision is disposed of, for no grounds to admit but for to represent the petition, returned by the trial Court vide order dated 18.03.2016, before the trial Court that unless there is a stay, from mere filing of an appeal, it is not a bar for withdrawal of amount in deposit but for to permit or not to decide on own merits. There is no order as to costs.
