THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.14631 of 2017 ORDER:
This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the inaction of respondents 3 & 4 in not disposing of the LRS Application No:379/Circle-12/W2/GRA/IC, dated 31.12.2010, for regularization of the petitioner's property Ac. 0.28 guntas, in Survey No.224 of Mythriinagar (Madeenaguda Village), Serilngampally Mandal & Municipality, Ranga Reddy District, in spite of the repeated representations, dated 25.07.2016 & 17.09.2016, as arbitrary and illegal.

Heard the learned counsel for both parties and perused the material available on record. With the consent of learned counsel for both the parties, the writ petition is taken up for disposal at the stage of admission.

The case of the petitioner is that the petitioner is the absolute owner and possessor of Ac. 0.28 guntas, in Survey No.224 of Mythriinagar (Madeenaguda Village), Serilngampally Mandal & Municipality, Ranga Reddy District, having purchased the same through registered Sale Deed No.23702/2006, dated 25.11.2006. The Government issued G.O.Ms.No.902, Municipal Administration & Urban Development Department, dated 31.12.2007, and issued amendment orders in G.O.Ms.No.113, dated 31.01.2008, issued by the Municipal Administration & Urban Development (M1) Department, the Regulations of Unapproved and Illegal Layout Rules 20007, and gave opportunities to the general public to
regularize their existing open plotted areas. In pursuance of the said Government Orders, the petitioner submitted an LRS application bearing No.379/Circle-12/W2/GRA/IC, dated 31.12.2010, along with plan for regularization of layout of the petitioner's subject plot, but till now the respondent authorities have not passed any orders on the said LRS application of the petitioner and the same is pending. The petitioner has also filed representations, dated 25.07.2016 & 17.09.2016, to the respondent authorities requesting them to regularize the subject plot of the petitioner, but the respondent authorities have not taken any action and the same are pending.

When the matter is taken up, both the learned counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the LRS application of the petitioner, dated 31.12.2010. 5.
Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the respondent authorities to consider the LRS Application bearing No.379/Circle-12/W2/GRA/IC, dated 31.12.2010, said to have been submitted by the petitioner for regularization of the subject plot of the petitioner basing on the representations of the petitioner, dated 25.07.2016 & 17.09.2016, and pass appropriate orders, as expeditiously as possible, in accordance with law, and communicate the decision to the petitioner. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
