THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3030 OF 2016 ORDER:

This petition is filed by the petitioners-A2 and A3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.201 of 2015 on the file of the Narsapuram Town Police Station, West Godavari District, registered for the offence punishable under Sections 3, 4 and 5(B) of the Prevention of Immoral Traffic Act. Heard and perused the material available on record. It is the case of the prosecution that A1 is the Manager of Raj Kamal Lodge and in order to earn extra income, he is doing prostitution business in Room No.114 of his lodge and at the time of raid, the petitioners were found there.

It is the case of the petitioners that they are neither living on the earnings of prostitution nor encouraging the same and that the entire allegations are made against A1 and the victim woman only and the proceedings against the petitioners are not maintainable. Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to interfere with the investigation.

Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ______________________ JUSTICE RAJA ELANGO Date : 9.3.2016 Nn
