HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40861 of 2016 ORDER:

Heard Mr.P.Rama Sharana Sharma for petitioner and Government Pleader for Civil Supplies for respondents. The petitioner challenges auction notice, dated 01.11.2016, whereunder the respondents scheduled to hold auction on 15.11.2016 at 11.00 a.m. The auction is now initiated pursuant to the order, dated 28.05.2016, of respondent No.2. The petitioner filed Criminal Appeal No.93 of 2016 before the learned Principal District & Sessions Judge, Srikakulam. The auction scheduled to be held on 15.11.2016 is postponed to 30.11.2016. Likewise, the stay petition filed by the petitioner stands posted to 12.12.2016. Having regard to these circumstances, the petitioner, it is alleged, is constrained to invoke the jurisdiction of this Court under Article 226 of the Constitution of India.

The Government Pleader does not oppose postponing the auction scheduled to be held on 30.11.2016 for a period of three weeks thereof and in the meantime, the petitioner can be given liberty to obtain orders from the learned Principal District & Sessions Judge, Srikakulam. The statement is placed on record. The writ petition is disposed of by postponing the auction scheduled to be held on 30.11.2016 by three weeks thereof and the

petitioner is given liberty to move the appellate authority for appropriate orders.
