THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11559 OF 2015 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking bail in S.C.No.110 of 2015 on the file of VII Additional District and Sessions Judge, Gudur, SPSR Nellore District which arose out of Crime No.234 of 2014 of Tada Police Station, registered for the offences under Sections 419, 420, 363, 395, 342, 489 and 201 IPC.
Heard and perused the records.
The case of the prosecution is that on the intervening night of 24/25-022014 while the de facto complainant was proceeding in a lorry with his owner and cleaner with chocolates load to Chennai and when they reached Periyvattu village of Tada Mandal, some unknown offenders crossed the lorry with Scorpio car, stopped the vehicle with a demand to show the documents and in the meanwhile, the offenders caught hold them and shifted into mini lorry along with his owner forcibly and left the place. On the way, they were thrown from the car at forest area and the culprits committed the theft of mini lorry along with chocolate load and kidnapped the owner. Learned counsel for the petitioner submits that the petitioner is in jail from 25.2.
2015 and that he was implicated in the case only with suspicion and that he did not have any role in the alleged commission of offence. While opposing the bail petition, the learned Additional Public Prosecutor submitted that this is the third bail application filed by the petitioner herein and that there are no change of circumstances to grant bail. The earlier bail application of the petitioner in Crl.P.No.7668 of 2015 was dismissed by this Court on 17.8.2015. The petitioner is a native of Gujarat State and that there are no substantial change of circumstances to enlarge the petitioner on bail at this stage.
