This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by petitioners/A.1 and A.2 seeking anticipatory bail in connection with Crime No.5 of 2026 of Mandamarri Police Station, Ramagundam Commissionerate, Mancherial District. The
- 2 - offences alleged against the petitioners are under Sections 109(1) r/w.Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that the complainant, Gorla Akhil gave a complaint before police on 06.01.2026 stating that on 05.01.2026 at about 2:00 PM, on the request of his friend SK Fayaz, he went to Mandamarri in his friend's car bearing No. TS 19 4344 to go to the GM Office, Godhavarikhani. While waiting at CER Club, Mandamarri, two unknown persons came to his car, knocked on the door, and repeatedly asked him for a lighter. When the complainant stepped out of the car, a grey color Swift car was driven towards him with an intention to kill him. The car hit him, causing bleeding injuries to his left heel and stomach. The complainant recognized the driver of the said car as Aasha Santhosh, who had previously attempted to attack him. Naresh was seated beside Aasha Santhosh, and another person was seated in the back.
The complainant also noticed that Bhargav was driving another grey Swift Desire car, in which the two persons who had asked him for a lighter were seated in the rear seat. It is further alleged that on 25.12.
- 3 - Bhargav, and their associates had earlier attempted to kill him by hitting him with a car due to previous grudges. After the incident, his friend SK Fayaz arrived and informed his brother Ankathi Mallesh. They immediately shifted the complainant to the hospital. Hence, requested the police to take necessary action against the accused basing on which, police registered the case against the accused for the above offences. 3.
Heard Sri Rajath Kumar Pradhan, learned counsel appearing for the petitioners and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for respondent-State.

The contention of learned counsel for the petitioner is that as a counter blast to the case registered against the defacto complainant for the very same offence, he filed this case against the petitioners. In fact, the mother of petitioner No.1 gave a complaint vide FIR No.115 of 2024 of Bellampalli II-Town police Station, Ramagundam, wherein the defacto complainant allegedly attacked on petitioner No.1 to kill him. The investigation in the said case was completed and charge sheet is also filed. The defacto complainant was arrested and was enlarged on bail. He further contended that even though no
- 4 - such incident occurred, the defacto complainant created a false story and implicated the petitioners in this case and the material part of investigation is already completed. Hence, prayed this Court to grant anticipatory bail to the petitioners. 5.
On the other hand, learned Additional Public Prosecutor opposed bail contending that keeping the previous grudges in mind, the petitioners herein hatched a plan to kill the defacto complainant and they instigated A.3 to arrange vehicles and other persons to execute the murder plan and to pay Rs.2,00,000/- for the same. Hence, the petitioners with an intention to kill the defacto complainant dashed him with car causing injuries to him. Hence, petitioners are not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, petitioners herein are arrayed as A.1 and A.2. According to the complainant, these petitioners have asked the complainant to give lighter by knocking the door of the car and when the complainant got down from the car, the driver of a grey color swift car drove the same and dashed to the complainant with an intention to kill him as a result, the complainant suffered injuries to his left leg
- 5 - and also hidden injuries in stomach. The driver of the grey color car is A.1 and A.2 sat in the said car, whereas according to the petitioners, earlier a case was registered against the defacto complainant for the offence under Section 109 of BNS by the mother of A.1 and as the petitioners herein are not coming forward for compromising the said crime, this case is foisted against the petitioners. Further other accused were arrested and released on bail. Considering that the injuries sustained by the complainant are simple injuries and the circumstances of the case, this Court deems it fit to grant anticipatory bail to the petitioners subject to the following conditions : i.
The petitioners/A.1 and A.2 shall surrender before Station House Officer, Mandamarri Police Station, Ramagundam Commissionerate, Mancherial District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, for the like sum each.
ii.
The petitioners/A.1 and A.2 shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.

The petitioners/A.1 and A.2 shall abide by the other conditions stipulated in Section 482
(2) of BNSS and co-operate with Investigating Officer in investigating the case. 7.
Accordingly, Criminal Petition is allowed.
Miscellaneous petitions, if any, pending shall stand closed.
