- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1836 OF 2017 ORDER :

This Contempt case is filed to punish the respondent for not implementing the order passed by this Court in W.P.No.35148 of 2016 dated 15.03.2017.

Learned Special Government Pleader produced the proceedings of the Registrar dated 18.12.2017. The proceedings would disclose that the Executive Council and the University in its meeting held on 14.12.2017, having regard to the report of the Committee appointed, decided to re-notify the ST (Women) vacancy of Assistant Professor of Education.

The direction of this Court was to complete the selection process of Assistant Professor in Education, meant to be filled up by Scheduled Tribe candidates within a period of eight weeks by duly taking note of the directions issued in W.P.No.33272 of 2013. There was no direction by this Court to issue appointment orders in pursuant to the selection process. The direction was only to complete the selection process. Thus, it cannot be said that the decision of the University to cancel the selection process, per se, would amount to violating the directions of this Court, in order to initiate proceedings of contempt under the Contempt of Courts Act. 4.

Accordingly, the Contempt Case is closed. However, it is open to the petitioner to avail appropriate remedies as available in law, if so advised, aggrieved by the decision of the University. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
