THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.784 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 22.02.2016 passed in W.P.No.5588 of 2016. By the said order, the Commissioner, Jangaon Municipality, Jangaon, was directed to take appropriate action upon the petitioner's representation dated 03.12.2015 in accordance with the due procedure after giving an opportunity of hearing to all parties concerned. The Municipal Commissioner of Jangaon Municipality filed a counter-affidavit stating that after receipt of the aforestated order, he considered the petitioner's representation dated 03.12.2015 and passed appropriate orders which were communicated to the petitioner, vide letter dated 09.09.2016.

No reply affidavit was filed rebutting the aforestated counteraffidavit averments. In the light of the aforestated averments, no cause is made out for exercise of contempt jurisdiction.
