THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.591 OF 2024 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.1291 of 2023 on the file of Gachibowli Police Station, Hyderabad, registered for the offences under Sections 417, 420 and 376 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Gachibowli Police registered a case for the offence under Section 420 of IPC against the petitioner for cheating the de-facto complainant. The allegation made by the de-facto complainant is that this petitioner promised to marry her and had physical relation over a period of six months prior to the complaint. 4.

Since both are adults and the allegation of the de-facto complainant is one of cheating, the relief of regular bail can be considered, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of

the X Additional Metropolitan Magistrate, Kukatpally at Prashanth Nagar, Cyberabad.

ii) The petitioner/Accused after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period four weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused shall not in any manner either approach the de-facto complainant or contact her. Failing which, the Police are entitled to seek cancellation of bail granted.

iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
