THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34744 of 2012 ORDER:
The petitioners, who are the residents of Subash Nagar, Nizamabad District, submitted a representation to the first respondent on 13.10.2012 complaining about the unauthorised construction made by the second respondent in the premises bearing municipal number 6-2-175/1 and 2 situated at Subash Nagar, Nizamabad. When no action was taken by the first respondent, the present writ petition was filed.

This Court, by order dated 09.11.2012, observed that the pendency of writ petition will not disable the first respondent from duly examining/considering the representation of the petitioners, dated 13.10.2012, and passing orders after hearing the petitioners and the second respondent. It was made clear that if any such orders are passed, the first respondent shall place the same before this Court on the date of next hearing.

Today when the case is taken up for consideration, the first respondent has not filed any counter and on the other hand, the second respondent submitted that the property was already sold through a registered transaction on 05.05.2011, before filing the writ petition. However, in view of the order dated 09.11.2012, the first respondent is directed to consider the representation of the petitioners, dated 13.10.2012, and inspect the premises constructed by the second respondent, if any, and also that of the petitioners, and take appropriate action in accordance with law.

The writ petition is disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
