The petitioner and the respondent herein are parties to a matrimonial dispute, wherein they have reached to an understanding which is reduced into writing vide Memorandum of Understanding (MOU) dated 17.09.2025.

The parties as per the said MOU have agreed to first record the mutual consent divorce decree and then go for distribution of jewellery between them.

However, when it came to implementation both the parties have entertained doubts about the sincerity of the other i.e., the petitioner had a doubt that once the jewellery is distributed the respondent would not come forward for signing mutual consent decree. Similarly, the respondent entertained doubt that once she signs mutual consent divorce decree, the petitioner would not return her jewellery.

Upon hearing both the parties, this Court suggested for recording mutual consent decree and then on the same day the jewellery be distributed.

The parties have thereafter come back and accepted first to get the mutual consent divorce decree recorded before the Family Court on 18.12.2025 and on the following day the Advocate Commissioner would visit the bank with both the parties to distribute the jewellery as per inventory report prepared by him upon providing him with decree of mutual consent.

In this regard, it is observed that both the parties need not hesitate to go forward with this procedure, as the concern of the respondent-wife is taken care of as the petitioner has given affidavit stating that he is willing to give entire jewellery of respondent once the mutual consent decree is recorded. It is also brought on record that after written undertaking was given by the petitioner, the respondent has also given undertaking expressing her willingness to get mutual consent decree recorded first

The respondent need not doubt about the distribution of the jewellery as the said jewellery is actually in the custody of the Court through Advocate Commissioner, who is holding the key to the locker of the bank.

To sum up, the parties shall record the mutual consent divorce decree before the Family Court on 18.12.2025 and on 19.12.2025, the jewellery would be distributed between the parties as per the inventory reported by the Advocate Commissioner and the matter shall be reported to this Court by the Advocate Commissioner by the next date of hearing.

It is further clarified that the mediator will be paid an amount of Rs.50,000/- by the petitioner and Rs.12,500/- by the respondent.

For reporting compliance of the today's order, list on 22.12.2025.
