THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11600 of 2016 ORDER:
This criminal petition is filed against the order of issuance of non-bailable warrant against the petitioner/accused in C.C.No.69/2013 (old CC.No.299/2013 on the file of VI Addl.Chief Metropolitan Magistrate, Nampally, Hyderabad) on the file of the XVI Special Magistrate, Hyderabad, vide docket order dated 16.09.2013. Heard both sides.
Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned order. However, it is open for the petitioner/accused to surrender before the Court below and file appropriate application to recall the warrant, within a period of 15 days from today. In such an event, the Court below shall dispose of the application of the petitioner on the same day on which it is filed on reasonable terms, in accordance with law. For a period of 15 days from today, the non-bailable warrant pending against the petitioner/accused shall not be executed.
The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
