HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 17560 of 2017 Order:

This Writ Petition is filed challenging the action of the second respondent in interfering with the peaceful possession and enjoyment of the petitioner's land and threatening to dispossess her without following due process of law.

The petitioner states that she is the owner of the property admeasuring Ac.0.60 cents in Survey Nos.254/1-3A (Ac.0.37 cents) and 255/1 (Ac.0.23 cents) situated at Mallavolu village, Machavaram Mandal, Guntur District.

Now the second respondent filed a counter stating that the Gram Panchayat has an intention to have a drainage canal near the tank which is situated in Survey No.231, but so far no decision has been taken with regard to drainage canal. The second respondent never wanted to dispossess the petitioner or claimed any part of the property. If at all any part of the property is required for public purpose, they would follow due process of law.

In view of the statement made by the second respondent in the counter affidavit, no further orders are necessary in the present Writ Petition except recording the said fact. The Writ Petition is, accordingly, closed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
