THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.40376 of 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondent in not investigating the Cr. No. 272 of 2012, though the said case is registered on 10-8-2012 as illegal, arbitrary, unjust and unfair apart from violation of Articles 14 and 19 (1) (g) of the Constitution of India and consequently direct the respondents herein to complete the investigation in respect of above said case and to file the charge sheet in the court concerned in accordance with Law."

When the matter is called today, written instructions, dated 11-12-2015 furnished by the Station House Officer, Medchal Police Station, Cyberabad have been placed on record by the learned Government Pleader for Home.

It is stated in the said written instructions that based on the investigation made in Crime No.272 of 2012 and basing on the legal opinion, a proposal was submitted to the superior officers with a request to accord permission to refer the case as "Lack of Evidence" and the D.C.P., Balanagar Zone, Cyberabad vide Memo No.253/Cr/A1/DCP-BZ/Cyb/ 2013, dated 24-10-2013 accorded permission to refer the case as "Lack of Evidence" and consequently final report is filed before the concerned Court. In view of the above developments, nothing survives for adjudication in this writ petition.

The writ petition is accordingly closed. There shall be no

order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
