HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION NO. 23814 OF 2015 ORDER:

Heard learned counsel appearing for petitioner and learned Standing Counsel for respondents.

The petitioner herein is the Field Assistant of H. Sodhanapalli Gram Panchayat, Narpala Mandal, Ananthaput District. He was appointed in the year 2006 and has been discharging duties in the said post. While so, a show cause notice dated 17.9.2014 was issued making certain allegations to the effect that the petitioner committed certain irregularities while discharging duties and the explanation was called for.

The petitioner submitted his explanation, but, without considering the same, the petitioner was kept under suspension. Against the said order, the present Writ Petition is filed. Learned counsel appearing for the petitioner submits that the order of suspension was passed without any valid reasons and therefore, the same is required to be set aside.

It is not possible to accept the submission of the

learned counsel appearing for the petitioner without going into the merits of the case. Since the order of suspension is passed pending enquiry, I am not inclined to go into the merit of the allegations levelled against the petitioner. Therefore, the 4th respondent -Project Director -cumJoint Secretary, District Water Management Agency, DWMA, Anantapur, is directed to conduct the enquiry and complete the same within a period of four weeks, and pass final orders. Failing which, the order of suspension dated 17.9.2014 shall stand revived.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
