HCJ & Dr.SA, J WP.No.1340 of 2019 Dt: 04.07.2019 ORDER: (per the Hon'ble Dr. Justice Shameem Akther) This writ petition, under Article 226 of the Constitution of India, is filed for issuance of a writ of Habeas Corpus alleging that one Mr. Afsar Khan detained the petitioner's daughter, namely, P.Dharani, and ultimately, sought a direction from this Court to the respondents to produce P. Dharani before this Court and set her at liberty.
Pursuant to the order passed by this Court on 27.06.2019, P. Dharani has been produced before this Court. This Court interacted with Dharani. She has stated that she is 22 years old and she married one Afsar Khan on 26.09.2017, after embracing Islam. She changed her name as Athiya Fatima. She left her parents house on 17.09.2018 and now she is living with her husband and willing to continue to live with him. We permitted Dharani to interact with her parents. Even after interacting with her parents, Dharani states that she wants to live with her husband only.
Under these circumstances, no case of illegal detention, as alleged by the petitioner, is made out.
The writ petition is devoid of any merit, and the same is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, shall also stand dismissed.
