HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

The petitioners claim that they are all either disabled, widows, orphans, old aged or patients suffering from serious illness and are leading their lives in a most pathetic manner. To lead a reasonable life for the persons who are suffering, Government formed a Scheme to grant pension and the scheme is notified vide G.O.Ms.No.135, Panchayat Raj and Rural Development (Rd.I) Department, dated 17.09.2014. The claim of the petitioners was considered. However, the pension is not sanctioned. Aggrieved thereby, this writ petition is filed.

Learned counsel for the petitioners contends that in the relevant columns of the statement drawn up by the Janmabhoomi Committee, their claim is shown to be as eligible, but for no reason the Committee has not approved their names for sanction of pension and the relevant column only says 'not approved'. On account of such denial, the pension is not granted to the petitioners even though they are found to be eligible.

As seen from the material papers, in Ex.P-3 the issue was considered by the Mandal Parishad Development Officer, Mandal Praja Parishad, Rolugunta (4th respondent) and he has submitted a report to the Project Director, D.R.D.A. (Pensions), Visakhapatnam (2nd respondent) vide his proceedings, dated 10.06.2015, asking the Project Director to look into the matter and

furnish further instructions. The Mandal Parishad Development Officer brought to the notice of the Project Director about nonrecommendation of the pension to the petitioners.

4. Having regard to the fact that a report is submitted by the Mandal Parishad Development Officer, Mandal Praja Parishad, Rolugunta (4th respondent), the Project Director, D.R.D.A. (Pensions), Visakhapatnam (2nd respondent) is directed to consider the said report, examine the eligibility of the claim of the petitioners for sanction of pension and if the petitioners are found to be eligible, appropriate orders be passed regarding grant of pension. The entire exercise shall be taken up and finalized within a period of four (4) weeks from the date of receipt of a copy of this order. If the petitioners are aggrieved by any decision of the Project Director, it is open for them to work out their remedies.
