HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.1327 OF 2020 ORDER:
When the matter is taken up for hearing, learned counsel on either side fairly concede that the issue involved in this writ petition is squarely covered by the order dated 15.04.2019 passed by this Court in Writ Petition No.7785 of 2019. In view of the said submission, following the order dated 15.04.2019 in Writ Petition No.7785 of 2019, this Writ Petition is disposed of directing the respondents to provide reconnection of power supply subject to petitioner depositing 50% of the amount assessed in the notice dated 05.12.2019 and payment of reconnection charges. If the petitioner complies with the directions of this Court and reconnection of power supply is provided, the respondents shall not demand the balance amount till the issue is decided under Section of the Electricity Act, 2003.
Reconnection and continuous supply of electricity depends on compliance of all other requirements. It is needless to say that if the petitioner pays 50% of the provisional assessment amount, the respondents shall restore the power supply to the petitioner's electricity service connection.
