Heard.

The grievance of the petitioner is that in pursuance of his application for mutation and grant of pattadar passbooks with respect to the land admeasuring Ac.5-00 gts., in Sy.Nos.264/A/2. 297/A, 298/B, 299 and 300/B situated at China Pendyala Village and Mandal, Warangal District, the 4th respondent has mutated his name only to the extent of Ac.1-20 gts., and remaining extent is not considered.

The present writ petition is filed seeking direction to the 4th respondent to grant pattadar passbooks with respect to the remaining extent and for mutation of the name of the petitioner in the revenue records. The affidavit of the petitioner, however, does not state the date on which he was granted mutation in respect of the land admeasuring Ac.1-20 gts., The claim of the petitioner is stated to be based on a Will, dated 11-06-2007 executed by his mother.

Obviously, if the petitioner's request for mutation in respect of the land admeasuring Ac.5-00 gts., is not considered and only the land admeasuring Ac.1-20 gts., is mutated, the petitioner has to seek appellate remedy against rejection of his claim for the balance extent and cannot approach this Court straight away by way of present writ petition. Hence, giving liberty to avail appellate remedy, the writ petition is dismissed. No costs.
