The learned counsel for petitioner submitted that the bail order condition to the effect that the petitioner/accused shall not leave Visakhapatnam till filing of charge sheet causes any amount of hardship because the petitioner/accused, who belongs to Eluru, West Godavari District, by virtue of this Order, has to remain in a lodge at Visakhapatnam and since it may take some more time to file charge sheet, it would be difficult for him to remain away from his family and incur the expenditure and therefore, the aforesaid condition may be either relaxed or suitably modified.
Per contra, the learned Special Standing Counsel for CBI would submit that the investigation is in advanced stage and if at this stage the condition is relaxed, it will hamper smooth investigation and therefore, the petition may be dismissed.
Having regard to the fact that it is a trap case and the investigation is in advanced stage and also having regard to the fact that the petitioner/accused, who belongs to Eluru, West Godavari District, has to confine himself to Visakhapatnam by virtue of the bail order condition, which will cause hardship to him, this Court is inclined to modify the Order passed by the learned Principal Special Judge for CBI Cases, Visakhapatnam, while granting bail. Accordingly, the petitioner/accused is permitted to stay in his native place at Eluru, West Godavari, but he has to appear before the Inspector, CBI, Visakhapatnam once in every fortnight on Monday between 10.00 am to 12.00 noon till charge sheet is filed.
With the above observation, the Criminal Petition is disposed of.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
