HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1377 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents particularly 2nd respondent in not transferring the petitioner from MPPS, Kummarigudem of Chandampet Mandal to MPPS, Akkaladevigudem of Chivemla Mandal, by considering the appeals filed on 10.10.2018 and 22.01.2019 as illegal and arbitrary and consequently sought a direction to the 2nd respondent to consider the petitioner's request and pass appropriate orders on the appeals preferred by the petitioner.

Heard Smt.Rajeshwari, learned counsel for petitioner and the learned Government Pleader for Services-I.

It has been contended by the petitioner that she is working as Secondary Grade Teacher at MPPS, Thurpugudem of Aleru Mandal, Nalgonda District. In the web counselling conducted by the respondents, the case of the petitioner was not considered and she was not transferred to MPPS, Akkaladevigudem of Chivemla Mandal, even though she is entitled to be transferred as per the points to which she is entitled to. The petitioner further submits that against non-consideration of her case for transfer to MPPS, Akkaladevigudem, the petitioner has preferred appeals before the 2nd respondent on 10.10.2018 and 22.01.2019. The counsel for petitioner contends that appropriate orders be passed in the writ petition directing the 2nd respondent to consider and pass orders on the appeals preferred by the petitioner.

Learned Government Pleader appearing for respondents contended that the case of the petitioner was considered as per her eligibility in the web counselling and orders have been passed rejecting her case on 06.10.2018. Aggrieved by the said order, the petitioner has preferred appeals before the 2nd respondent on 10.10.2018 and 22.01.2019. If the appeals are not disposed of, the same would be disposed of in accordance with law. This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the 2nd respondent to consider and dispose of the appeals preferred by the petitioner on 10.10.2018 and 22.01.2019, if not already disposed of, within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
