THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2736 OF 2015 ORDER:

The present criminal revision case is filed by the petitioners challenging the docket order, dated 12.10.2015, passed in Crl.M.P.No.424 of 2015 by the Sessions Judge, Vijayawada, Krishna District, whereby the Court below dismissed the petition for non-payment of costs of Rs.500/-.

Heard and perused the records.

Learned counsel for the petitioners submits that the petitioners herein filed Criminal Appeal before the Court below with a delay and the Court directed to petitioners to pay costs of Rs.500/- on or before 12.10.2015. He further submits that the counsel appearing before the Court below met with an accident and as such, they could not pay the costs. Hence, he prays this Court to set aside the docket order, dated 12.10.2015 in Crl.M.P.No.424 of 2015 and sought time to pay the costs. Considering the facts and circumstances of the case, the criminal revision case is disposed of with a direction to the petitioners to pay costs of Rs.500/- (Rupees five hundred only) on or before 15.12.2015 and on such payment, the Court below is directed to condone the delay and number the criminal appeal and proceed in accordance with law.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
