ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the 1st respondent in issuing the impugned proceedings dated 17.8.2009 returning the application of the petitioners for sanction of permission for construction of house in the premises bearing No.23-252/5A and 2/5B situated at Sannidanamvari Street, Satyanarayanapuram, Vijayawada-11, as arbitrary and illegal. The grievance of the petitioners is that without considering their application for grant of construction permission, the respondent-Corporation returned the same. While admitting the writ petition on 21.12.2009, this Court directed the 1st respondent to re-consider the application of the petitioners dated 17.08.2009 afresh. Counter-affidavit has been filed on behalf of the 1st respondent, wherein it is stated that pursuant to the said interim direction granted by this Court, the respondentCorporation considered the application of the petitioners and granted permission.

In the light of the said averments made in the counteraffidavit, the cause in the writ petition does not survive for adjudication.

Accordingly, the Writ Petition is closed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
