HIGH COURT FOR THE STATE OF TELANGANA THE HON'BLE THE CHIEF JUSTICE SRI RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY WRIT APPEAL No.64 of 2020 Date: 27.01.2020 Between:

Amurathavarshini Kirana and General Stores ... Appellant and Pingali Venkata Reddy and others.

...Respondents

Counsel for the appellant:

Mr. L.V. Ramana Rao Counsel for the respondent No.1: Mr. M. Saleem Counsel for the respondent Nos.2 to 4: GP for Revenue The Court made the following:

HCJ & AAR, J W.A. No.64 of 2020 Dt: 27.01.2020 JUDGMENT: (per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The appellant has challenged the legality of the order dated 10.01.2020, passed by a learned Single Judge in I.A.No.1 of 2020 in W.P.No.970 of 2020, whereby the learned Single Judge has stayed the operation of the order dated 23.12.2019, passed by the Revenue Divisional Officer and Agency Divisional Officer, Mulugu, in O.S.No.578 of 2019.

Since the order passed by the learned Single Judge is an adinterim order, the appellant is required to first exhaust all the remedies available to it before the learned Single Judge. However, according to the learned counsel for the appellant, the appellant has not even filed a vacate stay petition before the learned Single Judge. Therefore, the appellant is directed to first exhaust his remedies before the learned Single Judge.

Hence, this Court does not find any merit in the present appeal. It is, hereby, dismissed. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall also stand dismissed.
