Devireddy Guru Bhaskar Reddy And 3 Others v. State Of Andhra Pradesh And Another
THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.502 OF 2018 ORDER:
This petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.353 of 2017 on the file of the Station House Officer, Proddutur Police Station, YSR Kadapa District, registered for the offences punishable under Sections 498-A IPC and 3 and 4 of Dowry Prohibition Act.
2.
Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.
3.
Learned counsel for the petitioners would submit that all the allegations made in the F.I.R are absolutely false. He further contended that the parties have settled the earlier report lodged by the de facto complainant before the Lok Adalat. The petitioner-A4 is the distant relative of the other petitioners and ultimately prayed to allow the petition. 4.
Having argued for some time, learned counsel for the petitioners intends to withdraw the criminal petition. 5.
On the other hand, learned Assistant Public Prosecutor opposed the relief sought for by the petitioners in the petition.
6.
There are specific allegations against all the petitioners with regard to causing mental and physical harassment to the de facto complainant and also demanding additional dowry. The compromise entered in between the parties in earlier similar proceedings cannot be a ground. The report in this case is lodged on a subsequent cause of
action. The investigation has to be gone into. The petition is devoid of merit and is liable to be dismissed. 7.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
