HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10786 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent No.2 in passing the impugned order vide proceedings No.B/1061/2016, dated 21.06.2016, as arbitrary and illegal and consequently to set aside the same. 2.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Admittedly, aggrieved by the order of the 2nd respondentTahsildar, the petitioner has an alternative remedy of filing appeal and the same is not disputed by learned counsel for the petitioner. 4.

Learned Assistant Government Pleader for Revenue submits that the petitioner has an alternative remedy by way of filing an appeal under Section 5-B of the A.P. Rights in Land and Pattedar Pass Books Act, 1971 (for short, 'the Act'), he has to avail the same. 5.

In view of the above, the Writ Petition is disposed of at the stage of admission giving liberty to the petitioner to avail remedy of appeal under Section 5-B Act.
