THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6321 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/accused Nos.4 and 5 in C.C.No.505 of 2014 on the file of Additional Judicial First Class Magistrate Court, Khammam. 2 Heard the learned counsel for the petitioners, the learned counsel for the 2nd respondent and the learned Additional Public Prosecutor representing the State. 3 At the time of arguments, the learned counsel for the petitioners seeks permission of the Court to permit the petitioners to withdraw the petition with a liberty to avail the remedies available to them under law, including filing of a petition for discharge before the trial Court. He further submitted that the presence of the petitioners before the trial Court may be dispensed with for each and every adjournment.
4 Permission accorded. There is no dispute with regard to the identity of the petitioners who are staying U.S.A. and U.K. Even if the presence of the petitioners is dispensed with no prejudice will be caused to the 2nd respondent. Therefore, the presence of the Petitioners/Accused Nos.4 and 5 in C.C.No.505 of 2014 on the file of Additional Judicial First Class Magistrate Court, Khammam on each and every adjournment is hereby dispensed with. However, the petitioners/Accused Nos.4 and 5 shall appear before the trial Court as and when their presence is required.
5 With the above observations, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
