Smt. Satya Prabha Mishra, v. The Ap Housing Board And Another,
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.172 of 2009
ORDER
When the matter is taken up for hearing, learned counsel for the petitioner, on instructions, from her client informed the Court that the petitioner is willing to pay the entire amount demanded through impugned notice dated 08.12.2008.
Learned Standing counsel appearing for the respondents contends that as on 08.03.2008, the demanded amount was Rs.10,35,044/- and since petitioner is willing to pay the demanded amount nearly after 12 years, the respondents are entitled to calculate the interest. Therefore, he contends that let petitioner submit a representation to the respondents staking her claim to pay the entire demanded amount, and thereupon the respondents would consider the same and pass appropriate orders.
This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a representation within two weeks from the date of receipt of a copy of this order staking her claim to pay the entire demanded amount and upon receipt of such representation, the respondents shall consider the same and pass appropriate orders in accordance with law.
With the above direction, this writ petition is disposed of. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
