THE HON'BLE SRI JUSTICE S.RAVI KUMAR Tr.C.M.P.No.277 of 2016 ORDER:
This application is filed to withdraw O.P No.311 of 2016 from Family Court, Ranga Reddy District at L.B.Nagar and transfer the same to Senior Civil Judge, Gadwal, Mahaboobnagar District.
2. Petitioner herein is wife of the respondent. She filed the present application stating that her marriage with respondent was performed on 12.02.2012 at Royal Function Hall, Raichur Road, Mahaboobnagar District. She stated that after marriage, she joined the respondent at Nizampet, Hyderabad and led happy marital life for about 10 days and thereafter, respondent and his family members harassed her in many ways and tortured her both physically and mentally and as she was not able to meet their illegal demands, she lodged a complaint to police, who filed a charge sheet and same is registered as C.C.No.230 of 2012 pending on the file of Judicial Magistrate of First Class, Gadwal. She stated that as a counterblast, respondent filed the present O.P at Family Court, L.B Nagar, Ranga Reddy District to harass her.
She stated that there is every danger to her life in the hands of respondent and his family members at L.B.Nagar, therefore, it is difficult for her to attend Family Court, Ranga Reddy District at L.B.Nagar for defending the case. She further stated that with great difficulty she secured a job and there is no possibility of getting leave from her employer to attend the case at L.B.Nagar and her parents are not in a position to accompany her to L.B.Nagar. For these reasons, she prayed for transfer of O.P.No.311 of 2016 from Family Court, Ranga Reddy District at L.B.Nagar to Senior Civil Judge, Gadwal, Mahaboobnagar District.
3. This court directed the petitioner to take out personal notice to respondent by registered post with acknowledgment due and in
compliance of the said order, Advocate for the petitioner filed Memo stating that notice was sent to respondent and the same was personally served and filed postal acknowledgment along with Memo as proof of service.
4. In spite of service of notice, respondent neither appeared in person nor through any Advocate.
5. Heard Advocate for the petitioner.
6. Considering the reasons stated in the affidavit filed in support of the petition and the fact that respondent is attending Court at Gadwal in connection with C.C.No.230 of 2012 and also considering the convenience of wife, O.P.No.311 of 2016 is withdrawn from Family Court, Ranga Reddy District at L.B.Nagar and transferred to Senior Civil Judge, Gadwal, Mahaboobnagar District for disposal in accordance with law.
