SMT JUSTICE T.RAJANI CRIMINAL PETITON No.339 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 to A4, in Crime No.517 of 2017 on the file of Nellore (R) Police Station, SPSR Nellore District. The offences alleged are under Sections 307 r/w 34 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

It is the case of the prosecution that there was altercation between the defacto complainant and the petitioner No.1 and thereafter, all the accused way laid and attacked the deceased. Hence, the contention of the petitioners counsel that there was no intention on the part of the petitioners, to commit the murder of the deceased cannot be appreciated.

Hence, in view of the above, this court opines that this is not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed.

However, the petitioners can file a petition seeking for regular bail by surrendering themselves before the court below. The court below shall dispose of the bail application, if any filed,

expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 29.01.2018 SS
