Respondent/State Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in connection with Crime No. 95 of 2017 on the file of Easgaon Police, Adilabad District.

The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri H.Prahalada Reddy, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This Criminal Petition is filed by the petitioners/A-1 to A4 under section 437 and 439 Cr.P.C., seeking grant of bail to the petitioner, who is A-1 in Crime No. 95 of 2017 of Easagaon Police Station, Adilabad District registered for the offences punishable under section 302, 201 read with section 34 of IPC.

2. Heard both sides.

3. The counsel for the petitioner submits that as per the report given by the defacto-complainant, this petitioner has beat the deceased only on legs and that subsequently the case of the prosecution was developed, implicating A-2, saying that he beat on the head of the deceased. However, the allegation so far as this petitioner is concerned, is that she beat the deceased on legs. The issue between the parties is with regard to illicit intimacy against this petitioner. The petitioner/A-1 has been in jail since 04-12-2017.

4. Considering the nature and gravity of the allegations, this Criminal Petition is allowed and the petitioner/A-1 is directed to be released on bail on her executing a personal bond for Rs. 20,000-00 (Rs. Twenty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class, Sirpur (T), Adilabad District. The petitioner/A-1 shall appear before the Station House Officer, Easagaon Police Station, Adilabad District on every Sunday between 10.00 a.m. and 12.00 p.m., until further orders.

5. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed."
